Order Before: LIVELY and KEITH, Circuit Judges, PHILLIPS, Senior Circuit Judge This is an appeal by a 78 year old coal miner from a denial of black lung benefits by the Honorable Joseph P. Kinneary, S.D. Ohio. Appellant-Constantino DiBacco dug and loaded coal for more than 35 years. He began to experience shortness of breath as early as 1933.1 Appellant filed his action for black lung benefits under the Federal Coal Mine Health and Safety Act, as amended, on November 15, 1971. This application was denied initially and upon reconsideration a hearing was held before an Administrative Law Judge (ALJ) who by decision dated August 2, 1974 held that the appellant Mr. DiBacco is entitled to black lung benefits.
